These Terms & Conditions (Terms) govern your use of ZERO (ZERO, the Service), the Gmail triage tool available at zero.peakstate.global, operated by Peak State Global (we, us, our) from Australia. By signing in or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. About the Service
ZERO is a remote control for Gmail — a triage tool, not a mail client. It connects to one or more Google accounts you authorise and lets you clear your inbox from a single keyboard-first surface: reading messages on demand, archiving, starring, marking important, trashing, marking spam, replying, forwarding and composing, and creating rules and one-off sweeps that act on current and future mail. ZERO also hosts the Evernote Alias Router, which mints email aliases that file inbound mail into your Evernote notebooks, and can file a message as a task in Peak State Navigator.
ZERO keeps no copy of your mail. Messages are fetched from Gmail on demand and cached only in your browser for the session; nothing is stored on our servers. ZERO is not a backup, an archive, or a mail store, and must not be relied on as one.
2. ZERO acts on your live mailbox
This is the most important thing to understand about the Service. Actions you take in ZERO — archive, trash, mark as spam, forward, send, and applying rules or a sweep — are performed against your real Gmail account, immediately, and some of them are effectively irreversible. Rules and sweeps can act on many messages at once, including your existing backlog. Creating a rule also creates native Gmail filter(s) that continue to act on future mail until you delete them.
You are responsible for reviewing what an action or rule will do before you run it, especially in bulk. We are not able to recover mail that Gmail has deleted, nor to un-send a message. Where Gmail itself offers a recovery path (for example, Trash retention or undo-send), that path is Google’s, subject to Google’s terms and timeframes, not ours.
3. Not professional advice
ZERO is a productivity tool. Nothing the Service produces is professional advice of any kind — legal, financial, tax, or otherwise — and it does not consider your particular circumstances. Rule suggestions, categorisations, and any other output are general, automated conveniences only. Where a message or decision matters, exercise your own judgement and seek advice from a suitably qualified professional.
4. Automated and AI-generated features
Some features use artificial intelligence — for example, suggesting a triage rule for a sender, or inferring which Evernote notebook a renamed alias belongs to. To do this, message metadata and content (such as sender, subject and body text) or notebook names are sent to a third-party AI provider solely to produce that result. See our Privacy Policy for detail.
AI-generated output can be incorrect, incomplete, or miscategorised. Rules match on the fields you configure and may catch mail you did not intend, or miss mail you did. Treat every suggestion as a draft to review — not as a decision already made.
5. Accuracy of information
Information ZERO shows is drawn live from Gmail and other connected services. That data may be delayed, incomplete, duplicated, or reported differently than in the underlying account, and figures ZERO derives from it (such as how many rules match a message) may be wrong as a result. Verify anything important against Gmail or the source service before you act on it.
6. Eligibility and access
The Service is invite-only. You must be at least 16 years old and have the authority to accept these Terms to use ZERO. You are responsible for keeping your Google sign-in secure and for all activity under your account. If you grant others access to an account or mailbox connected to ZERO, you are responsible for what they do with it.
7. Connected accounts and services
To work, ZERO connects to third-party services on your instruction — principally Google (Gmail and Contacts), and, for the Evernote Alias Router, Evernote and our email-delivery providers. You warrant that you own, or are authorised to connect and act on, every account and mailbox you link, and every notebook or address you register. Those third-party services are governed by their own terms and privacy policies, which you are responsible for reading. Disconnecting an account in ZERO stops new access to it, but does not undo actions already taken.
8. Acceptable use
You agree not to:
- use the Service to send spam, phishing, or unlawful, harassing, or infringing content;
- connect an account or mailbox you are not authorised to access;
- probe, scrape, overload, reverse-engineer, or circumvent the security or rate limits of the Service or the third-party APIs it uses;
- use the Service to breach Google’s, Evernote’s, or any provider’s terms; or
- resell, sublicense, or provide the Service to third parties except as we expressly permit.
9. Your content
You retain all rights in your mail, notebooks, aliases, rules, and other content. You grant us a limited, non-exclusive licence to host, process, transmit, and display that content solely to operate the Service for you — for example, to fetch a message so you can read it, or to forward one on your instruction. This licence ends when the content leaves the Service, subject to the retention described in the Privacy Policy.
10. Our intellectual property
The Service itself — its software, design, and the ZERO name and marks — belongs to us or our licensors. These Terms grant you a personal, revocable, non-transferable right to use the Service, and nothing more. Third-party links or destinations reached through the Service are not under our control and we are not responsible for them.
11. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (Schedule 2), or any other law, that cannot lawfully be excluded (non-excludable guarantees).
Where the Service comes with a non-excludable guarantee and we are permitted to limit our liability for breach of it, our liability is limited, at our option, to re-supplying the services or paying the cost of having them re-supplied.
12. Warranties and disclaimers
Subject to clause 11, the Service is provided “as is” and “as available”, without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will fetch, match, send, or act on every message correctly or on time. The Service depends on third-party APIs (Google and others) that we do not control and that may change, rate-limit, or fail.
13. Limitation of liability
Subject to clause 11, and to the maximum extent permitted by law:
- we are not liable for any indirect, incidental, special, or consequential loss, or for loss of data, profits, or goodwill, however it arises;
- we are not liable for loss arising from actions taken through the Service on your live mailbox — including mail archived, sent, forwarded, trashed, or deleted, whether by you, by a rule, or by a sweep — or from decisions you make in reliance on the Service or its output; and
- our total aggregate liability arising out of or in connection with the Service is limited to the amount you paid us for the Service in the twelve months before the claim (if any).
14. Indemnity
You agree to indemnify us against claims, loss, and costs arising from your breach of these Terms, your misuse of the Service, or your connecting an account or content you were not authorised to connect — except to the extent the loss was caused by us.
15. Suspension and termination
You may stop using the Service and disconnect your accounts at any time. We may suspend or terminate your access if you breach these Terms, if required to protect the Service or comply with the law, or if we discontinue the Service. Clauses that by their nature should survive — including clauses 9–14 and 17 — survive termination.
16. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above shows when. Material changes take effect when posted; continuing to use the Service after that means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws in force in Australia, and you submit to the non-exclusive jurisdiction of the courts of Australia.
